Cancellation
According to KSchG § 5 f (2), there is no right of withdrawal for distance contracts for the delivery of goods whose
price or production price on the market is subject to fluctuations over which the operator has no influence and which
can occur within the usual withdrawal period.
Exceptions to the right of withdrawal:
The right of withdrawal does not apply to the following contracts (§ 312 g of the BGB):
a) To the delivery of goods which are not prefabricated and for the production of which an individual selection has been made
by the consumer or which is clearly tailored to the personal needs of the consumer.
(b) Contracts for the supply of goods or services, including
financial services whose price depends on fluctuations in the financial market over which the operator has no influence
and which may occur within the revocation period, in particular services in
connection with shares, with units in open-ended investment funds within the meaning of § 1 (4) of
Investment Code and with other tradable securities, foreign exchange, derivatives or
money market instruments.
